มูลนิธิเอ็มพาวเวอร์ขอเรียนเชิญสื่อมวลชนและประชาชนทั่วไปเข้าร่วมงานเสวนาในหัวข้อ “จับเข่าคุย ล่อซื้อ 10 ปี แก้ไขปัญหาการค้ามนุษย์หรือยัง?” เนื่องในสัปดาห์ต่อต้านการค้ามนุษย์ในวันศุกร์ที่ 1 มิถุนายน 2561 ณ ห้องอเนกประสงค์ชั้น 1 หอศิลปวัฒนธรรมแห่งกรุงเทพมหานครเวลา 10.30 น. – 16.00 น.

สืบเนื่องจากเดือนมิถุนายนถูกจัดให้เป็นสัปดาห์วันต่อต้านการค้ามนุษย์ และถึงแม้หลากหลายหน่วยงานจะออกมารณรงค์และทำงานในเรื่องนี้อย่างต่อเนื่องแต่สถานการณ์การค้ามนุษย์ในประเทศไทยกลับไม่ได้ดีขึ้นเลย โดยเฉพาะนโยบายการต่อต้านการค้ามนุษย์ที่มีไว้เพื่อปกป้องสิทธิของผู้หญิงแต่ยังมีผู้หญิงจำนวนมากที่ยังถูกจับและได้รับผลกระทบ โดยเฉพาะนโยบายและแนวทางการ “ล่อซื้อพนักงานบริการ” ที่ได้สร้างบาดแผลและผลกระทบให้กับพนักงานบริการและครอบครัวเป็นอย่างมาก

ทั้งนี้การ“ล่อซื้อพนักงานบริการ” เป็นวิธีการที่ไม่ถูกต้องตามหลังสิทธิมนุษยชน และ ป.วิอาญามาตรา 226 ถือว่าเป็นปฏิบัติการ ที่ร่วมกระทำความผิด การบุกทลายก็เป็นการละเมิดศักดิ์ศรีความเป็นมนุษย์ และเป็นการกระทำที่รุนแรงต่อพนักงานบริการ และสร้างผลกระทบต่อพนักงานบริการทั้งหมด ซึ่งในประเทศไทยมีพนักงานบริการประมาณ 3 แสนคน 10 ปีที่ผ่านมาจับผู้เสียหาย 300 คนทุกปี ซึ่งส่งผลกระทบกับคนที่ไม่เกี่ยวข้องกับการค้ามนุษย์ โดยเหตุการณ์ล่าสุดกรณีการบุกทลายที่นาตาลีอาบอบนวดจับผู้หญิงไป 121 คน ได้ผู้เสียหาย 15 คน ล่าสุดที่วิทตอเรีย ซีเคร็ทจับผู้หญิง 113 คน ได้ผู้เสียหาย 8 คน ส่วนคนที่เหลือถูกจับข้อหามั่วสุมในสถานค้าประเวณี ในหนึ่งปีพนักงานบริการถูกจับไม่น้อยกว่า 3 หมื่นคน ตามเจตนารมณ์ของพ.ร.บ.ปรามการค้าประเวณีเพื่อช่วยคนที่ด้อยโอกาส แต่เราเห็นว่าการจับกุมไม่ได้เป็นการให้โอกาสแต่อย่างไร

จากเหตุการณ์ต่างๆ เหล่านี้ ทำให้เห็นชัดเจนว่า การล่อซื้อและบุกทลาย เป็นการละเมิดสิทธิของพนักงานบริการอย่างมาก มูลนิธิเอ็มพาวเวอร์ได้ร้องเรียนไปยังคณะกรรมการสิทธิมนุษยชนในเรื่องนี้ และกรกฎาคม 2560 ประเทศไทยต้องรายงานต่อคณะกรรมการว่าด้วยการขจัดการเลือกปฏิบัติต่อสตรีทุกรูปแบบ หรือซีดอ(CEDAW) ว่าที่ผ่านมาได้มีการปฏิบัติต่อผู้หญิงในประเทศยังไง ตามอนุสัญญาที่รัฐบาลไทยได้ลงนามไว้ และ เอ็มพาวเวอร์ (EMPOWER Foundation) ได้ทำรายงานคู่ขนานไปยังคณะกรรมการซีดอ(CEDAW)จากเหตุการณ์ร้านนาตาลีกับสิ่งที่เกิดขึ้น ทำให้คณะกรรมการซีดอได้มีข้อเสนอให้กับรัฐบาลไทยต้องทำตามคือ ให้หยุดการล่อซื้อและบุกทลายทันที และให้ยกเลิกความผิดการค้าประเวณี ให้ใช้กฎหมายแรงงานเข้ามาคุ้มครองพนักงานบริการแต่แนวทางดังกล่าวนี้ก็ยังไม่ได้มีการนำมาปฏิบัติอย่างเป็นรูปธรรมจากหน่วยงานที่เกี่ยวข้องในประเทศไทย

ด้วยเหตุดังกล่าวนี้มูลนิธิเอ็มพาวเวอร์จึงได้เตรียมจัดเวที เสวนา “จับเข่าคุย ล่อซื้อ 10 ปี แก้ไขปัญหาการค้ามนุษย์หรือยัง?” ในวันศุกร์ที่ 1 มิถุนายน พ.ศ. 2561 เวลา 10.30 – 16.00 น. ที่ห้องอเนกประสงค์ชั้น 1 หอศิลปวัฒนธรรมแห่งกรุงเทพมหานครเวลา เพื่อเปิดโอกาสให้ทุกฝ่ายที่เกี่ยวข้องไม่ว่าจะเป็นตัวแทนพนักงานบริการ เจ้าหน้าที่ตำรวจ คณะกรรมการสิทธิมนุษยชน และองค์กรที่ทำงานเรื่องสิทธิของพนักงานบริการ ร่วมกันจับเข่าคุยเพื่อหาทางออกและวิธีการในการแก้ไขปัญหาที่เกิดขึ้นนี้อย่างเป็นรูปธรรมโดยไม่ละเมิดศักดิ์ศรีความเป็นมนุษย์และเคารพในสิทธิมนุษยชนขั้นพื้นฐานของพนักงานบริการทุกคน มูลนิธิเอ็มพาวเว่อร์จึงใคร่ขอเรียนเชิญสื่อมวลชนและประชาชนทั่วไปเข้าร่วมรับฟังการเสวนาและเข้าร่วมรับฟังข้อเท็จจริงจากปากของพนักงานบริการที่ได้รับผลกระทบด้วย โดยการจัดงานในครั้งนี้จะมีกิจกรรมที่น่าสนใจเป็นจำนวน ดังนี้

พบกับการจัดฉายภาพยนตร์สั้น “The Last Rescue in Siam” สาวน้อยผจญภัย ซึ่งเป็นภาพยนตร์ที่สะท้อนถึงอุปสรรคที่พนักงานบริการต้องพบเจอในการทำงาน
ร่วมรับชมนิทรรศการผ้าปัก “มิดะ” ความยาวว่า 5 เมตรจากสองมือของพนักงานบริการที่บอกเล่าความจริงและชะตากรรมที่พนักงานบริการต้องพบเจอและได้รับผลกระทบจากนโนบายการล่อซื้อของเจ้าหน้าที่
ชมนิทรรศการ “ช่วย ไม่ช่วย” โดยพนักงานบริการจากมูลนิธิเอ็มพาวเวอร์ สำหรับกฎหมายและแนวทางปฏิบัติในการต่อต้านการค้ามนุษย์

Upcoming event “Has 10 years of entrapment and raids solved trafficking?” during the Anti-trafficking Week Friday 1^st June 2018 at Bangkok Art and Culture Center (BACC) – Hall 1st Floor 10:00 am to 16.00 pm

The 10^th Anniversary of the Thai Human Trafficking Act 2008 and National Anti-trafifkcing Day are in the first week of June. Over the last 10 years many agencies have been running campaigns and projects but the issue of human trafficking has not been solved using the Human Trafficking Law. The anti-trafficking act was created to protect the rights of women, but in reality it has mostly been used to arrest women and women are the ones impacted by the law. In particular the practice of entrapment of sex workers is harmful and has serious impacts on women and their families.

Entrapment of sex workers is against human rights standards and also the Thai Criminal Procedure Code Section 226. Entrapment of sex workers is a process where those doing the entrapment are also breaking the law. The raids that follow abuse the right to human dignity, are acts of violence against sex workers and impact on all sex workers.
There are around 300,000 sex workers in Thailand. In the last 10 years about 300 victims of trafficking in prostitution are caught every year. Many more women who have nothing to do with human trafficking are arrested at the same time. For example in the Nataree Massage incident they caught 121 women but only got 15 victims. Most recently in the Victoria Secret raid 113 women were caught to get just 8 victims. Those who aren’t victims are charged under the criminal law for ‘associating in a place of prostitution’. Each year over 30,000 women are arrested under the Prostitution Act in Thailand. The letter or spirit of the Prevention and Suppression of Prostitution Act 1996 is to assist disadvantaged women but we see that arresting women is not providing any opportunities.

The Nataree Massage incident in 2016 allowed us to see clearly how entrapment and raids are violating sex worker’s rights. Empower submitted a report to the National Human Rights Commission on the practice.

In July 2016 Thailand was reviewed by the Committee of Experts on CEDAW to review its treatment of women in Thailand in accordance with its legal obligations under CEDAW. Empower Foundation submitted a Shadow Report largely based on our experiences including the Nataree incident. The Committee of Experts on CEDAW recommended that the Thai government must immediately end the practice of entrapment of sex workers and violent raids; end the criminalization of sex workers and enforce the labor law for the protection of sex workers. It is not clear what progress has been made towards this aim.

Therefore it is timely that Empower is hosting a seminar “Has 10 years of entrapment and raids solved trafficking?” at Bangkok Art and Culture Center (BACC) – Hall 1st floor Friday 1st June 2018, 10:00 am to 16.00 pm. The event will provide an opportunity for all those involved e.g. including sex worker representatives, police, the National Huma Rights Commission and other organizations working on the human rights of sex workers to explore solutions and methods to solve issues of trafficking without abusing the rights and dignity of women who do sex work, whether they are trafficked or not.

Empower Foundation invites the media and the public to join the seminar and listen to the real experiences of sex workers. The event has an interesting and varied program.
